‘Uqubah In Review Of Fiqh Siyasah

Abstract

Fiqh siyasah is part of Islamic law, therefore at the time of the Prophet and Khulafaur Rasyidin, Islamic criminal law applies as public law, namely the law that is regulated and applied by the government as the legitimate ruler or ulil amri. The public only understands that Islamic criminal law sanctions, if implemented, are cruel and terrible. Moving on from this, on this occasion the author will try to analyze and describe perfectly about sanctions ('uqubah) and how the form in Islamic criminal law as well as some important aspects in it. So based on the results of the study, 'uqubah is a recompense for the actions of criminals as a result of their actions to deter criminals and frighten others who have the potential to commit the same crime. The form of 'uqubah is in accordance with the crime committed, if the punishment for fornicate is lashing, the crime of stealing is cutting off his hand, killing qisha or diyat, and so are other crimes.. Determining 'uqubah in Islamic punishment is in accordance with the jarimah (criminal act) committed. A thief in instance has his hand cut off because his act of stealing is usually done by hand, a murderer is punished for taking another person's life, then the reward is that the perpetrator's life is removed so that it is commensurate, as well as other criminal acts.
